Do I need to register a business name?

You must register a business name if you operate a business under a name other than your own legal name. 

Sole traders using their personal name do not need to register a business name, but any other name requires registration with ASIC. 

Registering your business name also helps protect your brand identity.

Business names can be registered for either one or three years. 

You must renew before the expiry date to keep your registration active. 

ASIC will send reminders before your registration expires, so you can avoid your business name lapsing.

You will need an Australian Business Number (ABN) to register a business name. The ABN is required as part of the application process with ASIC. 

Obtaining an ABN also allows you to register for GST and other business-related tax obligations.

A trade mark registration lasts for ten years from the filing date. 

You can renew your trade mark, provided renewal fees are paid every ten years. 

Maintaining your trade mark registration gives you ongoing exclusive rights to use the mark in Australia.
